1. General Terms
Welcome to MedGulf General Trading LLC. These Terms and Conditions ("Terms") govern your use of our website (www.medgulf.co.ae) and the purchase of products and services from MedGulf General Trading LLC ("Company," "we," "our," or "us").
By accessing our website or engaging in business transactions with us, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of our services constitutes acceptance of any modified Terms.
2. Product Ordering
2.1 Quotation Process
- All product inquiries will receive a detailed quotation within 24-48 business hours
- Quotations are valid for 30 days unless otherwise specified
- Prices are subject to change based on market conditions and availability
- Custom products may require additional time for quotation
2.2 Order Placement
- Orders are confirmed upon receipt of a valid Purchase Order (PO)
- All orders are subject to product availability
- Minimum order quantities may apply for certain products
- Special orders or custom products may be non-cancellable once confirmed
2.3 Order Confirmation
- An order confirmation will be sent via email within 24 hours of receiving your PO
- Please verify all details in the order confirmation for accuracy
- Any discrepancies must be reported within 24 hours of confirmation
3. Pricing and Payment
3.1 Pricing
- All prices are quoted in UAE Dirhams (AED) unless otherwise specified
- Prices are exclusive of VAT unless stated otherwise
- Quoted prices are valid for the period specified in the quotation
- Prices may vary based on quantity, specifications, and delivery requirements
3.2 Payment Terms
- Standard payment terms are Net 30 days from invoice date for approved credit accounts
- New customers may be required to pay in advance or upon delivery
- Credit terms are subject to credit approval
- Large orders may require advance payment or Letter of Credit (LC)
3.3 Accepted Payment Methods
- Bank Transfer
- Cheque (subject to clearance)
- Letter of Credit (for large orders)
- Cash on Delivery (for approved orders only)
3.4 Late Payment
Late payments may incur interest charges at 2% per month on outstanding amounts. We reserve the right to suspend future orders if payment is overdue.
4. Delivery Terms
4.1 Delivery Locations
- We deliver across all Emirates in the UAE
- International shipping is available to GCC and Middle East countries
- Remote locations may incur additional delivery charges
4.2 Delivery Times
- Standard delivery within UAE: 2-5 business days
- Express delivery available upon request (additional charges may apply)
- International delivery times vary by destination
- Custom or special order products may require extended delivery times
4.3 Delivery Charges
- Delivery charges are calculated based on weight, volume, and destination
- Free delivery may be available for orders above a certain value
- All charges will be communicated in the quotation
4.4 Risk of Loss
Risk of loss and title for products pass to the buyer upon delivery at the specified delivery location.
5. Returns and Refunds
5.1 Return Policy
- Returns must be requested within 7 days of delivery
- Products must be unused, in original packaging, and in resalable condition
- Custom or special order products are non-returnable
- A Return Material Authorization (RMA) number must be obtained before returning any product
5.2 Defective Products
- Defective products will be replaced or repaired at no additional cost
- Defects must be reported within 48 hours of delivery
- Photographic evidence of defects may be required
- Products damaged due to misuse or improper handling are not eligible for return
5.3 Refund Process
- Approved refunds will be processed within 14 business days
- Refunds will be issued using the original payment method
- Restocking fees of up to 15% may apply for non-defective returns
- Shipping charges are non-refundable unless the return is due to our error
6. Warranty
6.1 Manufacturer Warranty
All products are covered by the manufacturer's warranty. Warranty terms vary by product and manufacturer. We will assist customers in processing warranty claims with the respective manufacturers.
6.2 Warranty Exclusions
- Normal wear and tear
- Damage caused by misuse, negligence, or improper installation
- Unauthorized modifications or repairs
- Damage caused by environmental factors or accidents
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- MedGulf General Trading LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the purchase price of the products giving rise to the claim
- We are not liable for delays or failures caused by circumstances beyond our reasonable control
- We make no warranties beyond those expressly stated in these Terms
8. Intellectual Property
All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of MedGulf General Trading LLC or its content suppliers and is protected by UAE and international copyright laws. Unauthorized use is prohibited.
9. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or confidential information exchanged during the course of business. This includes but is not limited to pricing, technical specifications, and business information.
10. Force Majeure
MedGulf General Trading LLC shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, strikes, government actions, epidemics, or supply chain disruptions.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Sharjah, UAE.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
